Terms of Service

By purchasing adopts/artwork from me you agree to the following Terms of Service

These Terms of Service apply to people who
• Buy adopts from me
• Buy commissions and artwork from me
• Buy adopts made by me from someone else
• Get into the possession of characters with artwork(s) made by me
• Please note that "buy" includes any kind of ownership transfer, including but not limited to purchasing, trading, receiving as a gift, etc.
• Please inform people about these Terms of Service if you give them characters made by me/artworks made by me. Some rules are general intellectual property law.

Ownership
You don't receive full rights over images.
• By purchasing a commission you keep full rights to your commissioned character(s)
• The purchase only includes the time being spent on
drawing the artwork, NOT the rights to it
• If not otherwise stated, I retain the right to upload and share the artwork
• I retain the right to ask for the artwork to be taken down if needed/wanted
• Mutual credits (= me giving you credit for character ownership too) are mandatory
• Credit to me must be easily accessible at all times (e.g. ToyHouse) or be clearly mentioned
Artwork credits must be given at all times (e.g. when uploading in a public space)
• I retain the right to ask for the artwork to be taken down if needed/wanted
• In case of a third-party reuploading a commissioned piece involving your character, you are allowed to ask for the image to be taken down as well as I am.

Adopt-specific Extra Rules
By purchasing an adopt you receive full ownership over the design.
• Adjustments to the design are allowed
• Completely changing the design beyond recognition cannot be forbidden but is not taken kindly
• By purchasing an adopt you do NOT receive full ownership over the artwork(s)
• Design credits must be given when required (e.g. ToyHouse)
• In the case of a successful scam (such as forcing a chargeback via PayPal after purchase of an adoptable) I take back the adoptable in question. Besides that, I do not force takebacks.

Commission Process
This goes for any kind of Commission
• If you have a deadline, tell me before I start work. I cannot guarantee I can fulfill deadlines down the line!
• Full payment has to be made before I start work. Please only pay when I tell you to (e.g. when it is your turn in case of a queue).
• I only make exceptions for frequent, good customers and mutuals I can trust. Please accept if I say No to other payment requests.
• In case of a cancellation, a full refund will only be given if you forfeit all rights to the commissioned piece and accept I may use it for other purposes OR if no work has been done yet.
• I do not give full refunds if a sketch or other already done work is wanted to be kept by the commissioner.
• I do not refund tips.
• I always send at least a sketch to be verified before I proceed to work.
• The commissioner is free to request more WIP shots (within reason).

Crediting
Any social media can be found on this carrd
• Credit the accounts on the social media you are posting on (e.g. tag my instagram on instagram; tag my ToyHouse on ToyHouse, etc.)
• In case of posting on a platform I am not on, please credit my instagram

Editing, Tracing, Theft, etc.
Any artwork made by me is allowed to
• be shared (with credit, refer to Ownership above)
• be edited for no profit (with credit), e.g. for collages - Asking for permission beforehand is required!
• be used to raise an adopt's worth and selling price (within the originally paid for price)
• be taken inspiration from

Any artwork made by me is NOT allowed to
• be sold/repurposed/printed/etc. for profit (e.g. merchandise - commercial usage requires an upcharge and new agreement)
• be edited/traced/copied for profit
• be traced/copied without permission as well as without credit
• be edited so signatures and/or logos are not visible/part of the image anymore
• Not crediting me and(!) claiming that you or someone else is the maker and/or owner of my artwork is considered theft and will be dealt with accordingly
• Sharing my art and refusing to give credit is reason to let the art be taken down forcefully

Blacklisting
By violating my Terms of Service you will not be allowed to purchase from me, whether it be commissions or adoptables
• Other products available for the public are not included (e.g. bases, store sales that do not include commissioned work)
• I hold the right to blacklist anyone who breaks my Terms of Service or who I do not wish to do business with.
